1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and HE Solutions, LLC ("Company," "we," "us," or "our"), governing your access to and use of the AtomicStep mobile application and website at atomicstep.app (collectively, the "Service").

By downloading, installing, or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old (or the minimum digital age of consent in your jurisdiction) to use the Service.

2. Description of the Service

AtomicStep is a voice-based AI productivity tool designed to help users overcome task avoidance and initiate action by breaking tasks down into smaller, manageable steps through conversational AI.

The Service is a general-purpose productivity tool only. It is not a substitute for professional mental health care, therapy, psychiatric treatment, counseling, coaching, medical advice, legal advice, financial advice, or any other professional or regulated service. If you are experiencing significant mental health difficulties — including severe anxiety, depression, ADHD, suicidal ideation, or other conditions — please seek help from a qualified healthcare provider.

The Service is not designed or intended for use in emergencies, high-stakes decisions, or any situation where inaccurate output could result in harm. See Section 9 for additional guidance on emergency situations.

3. Account Registration and Security

You may sign in to the Service using Apple Sign In. You are responsible for maintaining the security of your device and any credentials used to access the Service. You must promptly notify us at support@atomicstep.app if you suspect unauthorized access to your account.

You may not share your account with others or create multiple accounts to circumvent subscription restrictions.

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Attempt to reverse-engineer, decompile, or extract the source code of the Service.
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
• Circumvent access controls, including by creating accounts to bypass subscription paywalls.
• Transmit malicious code, spam, or unauthorized communications through the Service.
• Use the Service for any purpose that is unlawful, harmful, fraudulent, or abusive.
• Scrape, crawl, or systematically extract data from the Service.

We reserve the right to suspend or terminate your access for violations of these Terms, at our sole discretion.

6. Voice Input and AI-Generated Content

The Service uses artificial intelligence (powered by third-party AI service providers) to process your voice input and generate responses. You acknowledge and agree that:

• AI systems are non-deterministic — the same input may produce materially different outputs at different times.
• AI-generated responses may be inaccurate, incomplete, misleading, biased, inappropriate, dangerous, or harmful, regardless of how reasonable they may appear.
• AI-generated content is not professional advice of any kind — including but not limited to medical, mental health, psychiatric, psychological, therapeutic, legal, financial, safety-related, or life advice.
• You are solely and exclusively responsible for independently evaluating any suggestion, recommendation, task, or plan generated by the Service before deciding whether to act on it.
• You must exercise your own independent judgment in all circumstances. The Service is a starting point for your own thinking, not a directive to follow.
• We do not guarantee that the AI will correctly understand your input, assess your personal circumstances, or provide responses suited to your needs, safety, or wellbeing.
• We are not responsible for any consequences — including personal injury, emotional harm, financial loss, property damage, or any other outcome — arising from your decision to follow or act upon any AI-generated suggestion.

By using the voice feature, you grant us a limited, non-exclusive license to process your audio input solely for the purpose of delivering the Service to you. We do not use your content to train AI models without your explicit consent.

7. No Professional Relationship

Your use of the Service does not establish any professional relationship between you and HE Solutions, LLC, its employees, contractors, or the AI systems it operates. Specifically:

• No therapist-patient, doctor-patient, counselor-client, attorney-client, financial advisor-client, coach-client, or any other professional or fiduciary relationship is created by your use of the Service.
• HE Solutions, LLC and its personnel are not licensed mental health professionals, medical doctors, therapists, psychologists, psychiatrists, lawyers, financial advisors, life coaches, or any other type of regulated professional.
• The AI powering the Service is a general-purpose language model and does not hold any professional license or certification.
• No duty of care beyond what is expressly stated in these Terms is assumed by HE Solutions, LLC in connection with your use of the Service.
• AI-generated outputs are not professional opinions, diagnoses, prescriptions, treatment plans, legal strategies, or financial recommendations.

8. Assumption of Risk

YOU EXPRESSLY ACKNOWLEDGE, UNDERSTAND, AND VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH YOUR USE OF THE SERVICE AND ANY ACTION YOU TAKE BASED ON AI-GENERATED CONTENT. BY USING THE SERVICE, YOU ACKNOWLEDGE THAT:

• Artificial intelligence technology is experimental, inherently unpredictable, and prone to errors, hallucinations, and unexpected outputs.
• The AI may generate suggestions that are factually incorrect, contextually inappropriate, or that could cause harm if followed without independent verification.
• You are voluntarily choosing to use an AI-powered tool and you understand the limitations of AI-generated content.
• You bear sole and full responsibility for any decision you make or action you take that is influenced by or based upon the Service's output.
• HE Solutions, LLC has no control over and expressly disclaims responsibility for how you choose to interpret or act upon AI-generated suggestions.
• The non-deterministic and generative nature of the AI means the Company cannot predict, review, or guarantee every output the Service may produce.

YOUR ASSUMPTION OF RISK IS A MATERIAL CONDITION OF YOUR USE OF THE SERVICE. IF YOU ARE NOT WILLING TO ASSUME THESE RISKS, DO NOT USE THE SERVICE.

9. Emergency Situations

THE SERVICE IS NOT DESIGNED, INTENDED, OR SUITABLE FOR USE IN EMERGENCY SITUATIONS.

If you or someone else is in immediate danger, experiencing a medical or psychiatric emergency, contemplating suicide or self-harm, or in any situation requiring immediate professional intervention, you must:

• Call emergency services immediately (911 in the United States, or your local emergency number).
• Contact the 988 Suicide and Crisis Lifeline by calling or texting 988 (US).
• Contact a licensed mental health professional, doctor, or appropriate crisis service.

The Service is not monitored in real-time. We cannot detect distress signals, assess your safety, or contact emergency services on your behalf. Do not rely on AtomicStep in any situation where timely or accurate information is critical to your safety or the safety of others.

10. Intellectual Property

The Service, including its design, code, branding, text, and AI-generated responses, is owned by or licensed to HE Solutions, LLC and is protected by intellectual property laws. These Terms do not transfer any ownership rights to you.

You retain ownership of any content you input into the Service. By using the Service, you grant us a limited license to process and store that content solely to provide the Service.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR CONTINUOUSLY AVAILABLE.

WE MAKE NO REPRESENTATIONS OR WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, SAFETY, OR SUITABILITY OF ANY CONTENT GENERATED BY THE AI SERVICE. AI-GENERATED CONTENT IS PROVIDED FOR GENERAL INFORMATIONAL AND PRODUCTIVITY PURPOSES ONLY AND MAY NOT BE RELIED UPON FOR ANY CONSEQUENTIAL DECISION.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HE SOLUTIONS, LLC AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO:

• Indirect, incidental, special, consequential, or punitive damages;
• Personal injury, bodily harm, or death;
• Emotional distress or psychological harm;
• Loss of data, lost profits, or business interruption;
• Property damage;
• Any harm resulting from your reliance on, or decision to act upon, AI-generated content.

THIS LIMITATION APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE).

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) FIFTY DOLLARS (USD $50).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

13. Indemnification

You agree to defend, indemnify, and hold harmless HE Solutions, LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any action you take or fail to take in reliance on AI-generated content from the Service.

14. Third-Party Services

The Service integrates with various third-party services for functionality such as authentication, AI processing, subscription management, data storage, and analytics. Current providers include Apple Sign In (authentication), Groq and Google Gemini AI (voice transcription and response generation), Inworld/OpenAI/Cartesia (text-to-speech when enabled), RevenueCat (subscription infrastructure), PostHog (analytics), and Convex (application data infrastructure). Your use of those services is governed by their respective terms and privacy policies, and we are not responsible for their conduct or the accuracy of any AI outputs produced by third-party AI infrastructure.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violations of these Terms. Upon termination, your right to use the Service ceases immediately. Sections 7, 8, 9, 11, 12, 13, and 16 survive termination.

You may stop using the Service at any time. To delete your account and associated data, open the app and tap the menu icon (⋯) then select Delete Account. Your data will be removed within 30 days of your request. For help, contact us at support@atomicstep.app.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles.

Any dispute arising from these Terms or the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent infringement of intellectual property rights.

17. Changes to These Terms

We may modify these Terms at any time. When we do, we will update the "Last updated" date and, for material changes, notify you via the app or email. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
